| Advertisement Evans' attorneys allege the transfer occurred without her knowledge on Thursday, the same day she filed for divorce in chancery court and a restraining order was granted that prevented such actions. "He took $207,500 out of a joint checking account and a business account," said John Hollins Jr. , who represents Evans with his father, John Hollins Sr. "Those funds were put in the parties' joint tithing account that already had $66,500 in it. Then he liquidated the entire account of $274,000 and transferred it to a U. S. Bank account in Portland (Ore.) in his sole name. This was their tithing account, set up just for church tithes, and he knew that." There was no answer at the couple's Oregon home, where Schelske is believed to be staying. Hollins Jr. said his firm had contacted the Oregon bank to request that the account be frozen. Hollins Sr. said, "Obviously the reason why we filed this is, he took the money out of their marital accounts and put it in his separate account, which is in violation of the statutory restraining orders. " It could not be determined whether Schelske had hired an attorney to represent him in the divorce proceedings. No court date has been set. Monday's amended filing stated, "The Wife alleges that unless restrained and enjoined by this Honorable Court the Husband will continue to withdraw funds from the parties' SunTrust Signature Advantage checking account. ." ".Wife and the children will sustain irreparable harm and injury as a result. In addition, the Wife fears that unless restrained and enjoined the Husband will attempt to liquidate and dissipate other marital assets." The complaint requested that the court issue temporary restraining orders that prohibit Schelske from withdrawing any funds from the couple's SunTrust accounts in Nashville or his U.S. Bank checking account in Oregon, as well as any other accounts until further court orders. In addition, it requests that he be prevented from liquidating or dissipating any other marital assets at any time until further court orders. Schelske, 43, has been president of Gingerdog Inc. , which guides entrepreneurial aims of Evans' career. He does not serve as manager of her overall career; she is managed by Modern Management of Nashville. He is also chairman of CRAIG PAC, a national political action committee focused on helping elect Republicans to office, and executive director of AmericanDestiny. com, an organization that seeks to teach students about America's philosophical and religious origins. "During their marriage, the parties have accumulated substantial assets that were earned almost exclusively by the Wife," the filing stated. "In addition, during the marriage the Wife's financial advisor, John R. Sayles of Trust Corps Management Services Inc., has paid the living expenses of the parties in Tennessee, Oregon and California." The couple, who have not spoken since Thursday's divorce filing, have homes in Franklin and Oregon, and were renting a home in Beverly Hills, Calif. , while Evans was a contestant on the ABC show "Dancing With the Stars." They married in 1993, and their children are ages 2, 3 and 7 years old. Evans, 35, was back in Nashville on Monday, after taping an interview Saturday that will be aired tonight on "Dancing With the Stars. " "She did an interview explaining her reasons for withdrawing" from the show, Hollins Jr. said. Evans' "Stars" spot is expected to be about seven minutes long and will not go into detail about her divorce allegations but should contain general statements about her leaving the show. She is not expected to give any other interviews for a while. Evans' original divorce complaint accused Schelske of committing adultery with the children's former nanny, verbally abusing Evans and frequently watching pornography in their home. It claimed that Schelske had photos of himself having sex with other women, as well as 100 nude photos of himself in an aroused state. In addition, Evans claimed in the filing that he frequently threatened her, "told her she is crazy," and told her he would take the children to Oregon. In a statement released Friday, Schelske adamantly denied the allegations. "As distressing as it is to have to communicate about this matter publicly, Sara has unfortunately become a dramatically different person over the last year and it is something we have struggled to deal with. Sadly, it appears we have failed." In response, Hollins Sr. said, "Mr. Schelske is quoted in the press as saying he has done nothing wrong. He has the same information that we have on his computer unless he has destroyed it. The reason Sara Evans filed for a complaint for divorce when she did was to protect her children.
