I don't think Denis has threatened a lawsuit.
I don't believe he would do that unless he was pushed right to the brink. The party has told him repeatedly that "this is just process, we can't do anything about it, constitutionally we have open nominations, ect". Fine.
But now you have a situation where there is a sitting MLA that wants to continue being challenged by someone who didn't follow the proper procedure for the nomination. In a neutral environment, there is no question what needs to happen; Denis must be acclaimed. Does the party want Denis Rocan gone so badly that they would go against the constitution in order to try and get rid of him?
Is it worth a lawsuit? What if the nomination goes ahead and Denis still wins? What then?
Denis apparently handed in over 500 memberships on the final day. The nomination is held far away from Blaine's core support. It is a very real possibility that Rocan will hold off this challenge and return to caucus as the Carmen nominee.
I think it may be time to cut our losses and just hand this thing to Denis because this one will just keep getting messier otherwise.
