Madonna May Face Adoption Heartache - Expert

Madonna may still face heartbreak over the adoption of one-year-old African baby David, a leading international lawyer warned today.

A bodyguard and carer whisked Malawi-born David Banda from the superstar singer's private jet at Heathrow to her luxury four-storey home near Marble Arch in central London.

The lucky tot arrived at his plush new surroundings at around 7.

45am this morning, hidden from the world's glare in a blanket as he was rushed from the silver people carrier to his new millionaire lifestyle.

Hundreds of photographers and reporters were camped outside the property, waiting for their first sighting of mother and child.

Many experts believe the constant media attention is something the child will have to get used to.



However, specialist international family lawyer, Dr Anne-Marie Hutchinson OBE, warned Madonna she could still face a custody battle if the Malawi Government asked for the child who was flown out of the impoverished African country yesterday before lawyers could block the adoption.

Ms Hutchinson said: "As I understand it, Madonna must have had entry clearance in Britain to bring the child back here. There are strict rules on bringing in children on inter-country adoption.



"She must have undergone a full home study check at her property over here.

"Because of the speed at which the child was adopted in Malawi, we are not sure yet at what stage the process of adoption has reached over there.

"We also need to bear in mind that Madonna has donated a large amount of money into the Malawi economy to help people over there and I am sure the government will bear that in mind when making any future decisions.



"However, if the adoption process was still going on in Malawi and the government over there were to ask for the child to be returned for any reason, I have no doubt English courts would be in favour of doing so.

"In recent history, we had the case of the internet twins, which were adopted over the web, but as soon as America discovered what was happening, they asked for them to be returned and in that case, the English courts were minded to do so.

"Across the world, it has been agreed in most countries that we mutually recognise adoption.

This is certainly the case in most European countries and America, but I do not think we recognise adoptions in Malawi. There is still a long way for this matter to go."

She continued: "It seems that Madonna and her legal team have set things up at this end, but this matter will not be resolved until they have had full clearance form the Malawi courts.



"This type of inter-country adoption is horrendously expensive and for most normal couples, it would be a case of having to re-mortgage the house. Obviously in this case money is not an issue and it is a fact that Madonna can afford the top law team available."
